Update: Action Taken Against Clearview AI

November 14th, 2023 --- In October, the UK's First-tier Tribunal overturned the Information Commissioner's Office (ICO) fine and enforcement notice against Clearview AI.

The ICO had fined Clearview AI in May 2022 for processing personal data related to monitoring the behavior of individuals in the UK. The tribunal concluded that although Clearview AI's processing was "related to" monitoring carried out by its clients, UK data protection law could not have extraterritorial effect in this specific situation. The tribunal also found that Clearview AI was a controller for creating the database and a joint controller with its clients for matching images, inconsistent with guidance from the European Data Protection Board and the ICO.
